Amend Pacific Quotas Programme to issue 6-month temporary working visas

Petition request

That the House of Representatives urge the Government to amend the Pacific Access Category and Samoan Quota ballots so that successful ballot applicants are issued a 6-month temporary working visa enabling them to travel to New Zealand, secure employment, and satisfy scheme requirements in person.

Why this petition

We believe the current requirements are practically impossible and create risks. In our experience, it is very difficult for Pacific-based applicants with no NZ working experience to obtain a job offer from an employer they have not met, and we think this creates opportunities for unscrupulous individuals to sell “job offers”. We seek a practical amendment that will reduce uncertainty for applicants, prevent exploitation, and strengthen New Zealand’s relationships with its Pacific partners.

What is the Topic?

This petition concerns the Pacific Access Category (PAC) and the Samoan Quota, which are visa pathways allowing citizens from Pacific Island nations to live and work in New Zealand. Currently, successful applicants must secure a job offer from a New Zealand employer before they can travel. The petitioners want the government to change this rule so that winners receive a 6-month temporary working visa first. This would allow them to fly to New Zealand, find a job in person, and then convert that status into a longer-term residency visa.

Current Situation

Under the current system, applicants based in the Pacific must obtain a valid job offer from a New Zealand employer they have not met. The petitioners argue this creates a "catch-22": it is difficult to get hired remotely without local experience, yet one needs local experience to be hired. This gap has reportedly led to a market where unscrupulous individuals sell fake or low-quality "job offers" to desperate applicants, creating financial risk and exploitation.

Arguments in Favour

  • Practicality: Allowing applicants to travel first makes it easier to secure genuine employment, as interviews and trials can happen in person.
  • Protection: It reduces the incentive for scams involving the sale of job offers, protecting vulnerable applicants from financial loss.
  • Diplomatic Relations: A smoother process strengthens New Zealand’s positive relationships with Pacific partner nations.

Arguments Against

  • Immigration Control: Granting entry before a job is secured may lead to an increase in people remaining in New Zealand without the intended employment, potentially straining public services.
  • Labour Market Integrity: The current requirement ensures that visa holders are already employed, which aligns with New Zealand’s goal of filling specific skill shortages rather than general labour needs.
  • Administrative Burden: Managing a temporary visa pathway that requires subsequent conversion adds complexity to the immigration process for Immigration New Zealand (INZ).

Relevant Context

The Pacific Access Category is a long-standing initiative designed to support economic development in the Pacific while addressing labour shortages in New Zealand. According to the Ministry of Business, Innovation and Employment (MBIE), the scheme is strictly capped by annual quotas. Critics of the current system point to rising reports of fraud in the job-offer stage, while supporters of the status quo emphasize the need to maintain strict compliance with immigration laws to ensure the scheme remains sustainable and fair to all applicants.
