Licensing and oversight for debt collectors and credit reporting agencies

Petition request

That the House of Representatives introduce licensing and oversight for debt collection and credit reporting agencies, require independent verification of debts before credit reporting, and strengthen regulation and accountability of credit reporting agencies.

Why this petition

I consider that debt collection agencies are a source of consumer harm in New Zealand, including pressure tactics, disputed or inaccurate debts, and limited effective oversight. Compared to other sectors with significant power over individuals, I feel they have fewer licensing, verification, or accountability standards. In my view, strengthening oversight and requiring independent verification would address these gaps and prevent unfair or incorrect harm from unverified financial information.

What is this about?

This petition asks the New Zealand Government to create a formal system for regulating two types of companies: debt collectors (agencies hired to chase unpaid bills) and credit reporting agencies (companies that record your financial history, such as Equifax or Illion). Currently, there is no specific law requiring these agencies to hold a license or undergo regular government checks. The petition seeks to introduce licensing, require proof that a debt is real before it is reported, and increase accountability.

Current Situation in New Zealand

Unlike banks or lawyers, debt collectors and credit reporters are not currently subject to a dedicated licensing regime. They operate under general consumer protection laws, such as the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. While the Financial Markets Authority (FMA) regulates banks, it does not directly oversee private debt collection agencies. This gap has led to concerns that some agencies may use aggressive tactics or report inaccurate data without facing specific regulatory penalties.

Arguments in Favour

  • Consumer Protection: Supporters argue that many people face harassment or stress from collectors pursuing debts that are disputed or incorrect.
  • Accuracy: Requiring independent verification before a debt appears on a credit file could prevent innocent people from being denied loans or jobs due to errors.
  • Accountability: A licensing system would give the government a clear tool to suspend or ban agencies that break the rules, similar to how other professional sectors are managed.

Arguments Against

  • Red Tape and Cost: Industry groups often argue that new licensing requirements would increase administrative costs, which could be passed on to consumers or reduce the number of agencies willing to operate in New Zealand.
  • Existing Laws: Opponents may contend that current laws already prohibit harassment and false reporting, and that the issue is better solved by enforcing existing rules rather than creating new ones.
  • Complexity: Critics might argue that defining "independent verification" is legally complex and could slow down the process of settling legitimate debts.

Relevant Context

Debt collection is a significant industry in New Zealand, handling billions of dollars in unpaid accounts annually. The Ministry of Business, Innovation and Employment (MBIE) oversees fair trading but has noted in past reviews that the sector is fragmented. Recent public interest has grown due to high-profile cases of individuals being blacklisted by credit agencies based on outdated or incorrect information. The petition reflects a broader trend in New Zealand to tighten oversight of industries that have significant power over individual financial standing.

👎 Against David K. 22 Sept 2026
More licensing means consumers pay the compliance cost through higher collection fees. Better to make the current complaints and dispute resolution pathways actually work before building a new regulator.
👍 For Jaxon Baker 21 Sept 2026
An agency can wreck someone's credit over a disputed phone bill and there is almost nowhere to go. Licensing other 'responsible' industries is treated as obvious — this should not be a hard sell.
