Offer child sexual abuse protection education to all children in years 1-8

Petition request

That the House of Representatives amend the Children's Act 2014 to mandate that all children in primary education years 1 to 8 are provided with child sexual abuse (CSA) protection education in alternate years with an 'opt out' clause.

Why this petition

CSA harms children and can cause lifelong disadvantage. Research indicates that 15% of NZ children are sexually abused before the age of 16. I believe that a key strategy to reduce CSA is to provide children with CSA protection education and the logical venue for this is at school. In my view, legislation is needed to move from random to equitable provision of the programme Keeping Ourselves Safe (or its equivalent), and that it should be delivered in alternate years with an ‘opt out’ clause.

What This Petition Is About

This petition asks the New Zealand Parliament to change the Children's Act 2014. The goal is to make it a legal requirement for all schools to teach children in Years 1 to 8 about protecting themselves from sexual abuse. The petition proposes this education be delivered every second year. It also includes an "opt-out" clause, meaning parents can choose to remove their child from these specific lessons if they wish.

Current Situation in New Zealand

Currently, there is no national law forcing all primary schools to teach specific child sexual abuse (CSA) prevention programs. While many schools use programs like Keeping Ourselves Safe (KOS), participation is voluntary and varies by school. This means some children receive consistent education while others do not, depending on their specific school's policies. The petition argues this creates an unfair gap in protection.

Arguments in Favour

  • Equity: Making the program mandatory ensures every child, regardless of where they live or which school they attend, receives the same safety education.
  • Prevention: Proponents argue that teaching children to recognize unsafe situations and report them can reduce the risk of abuse. The petition cites research suggesting 15% of NZ children experience sexual abuse before age 16, highlighting the scale of the issue.
  • Consistency: Delivering lessons in alternate years ensures regular reinforcement without overloading the curriculum.

Arguments Against

  • Parental Rights: Critics often argue that education regarding sensitive topics like sexuality and abuse should remain under the direct control of parents, not the state. The "opt-out" clause addresses this, but some argue the default should be "opt-in."
  • Teacher Training: There are concerns that teachers may not have sufficient specialized training to handle these difficult topics effectively or safely, potentially causing distress if not managed correctly.
  • Curriculum Burden: Opponents may argue that adding mandatory content could strain an already busy school timetable.

Relevant Context

The Keeping Ourselves Safe program is a well-established initiative in New Zealand designed to help children understand their rights and safety. The Children's Act 2014 is the primary legislation governing the welfare and safety of children in the country. While the government has previously funded and promoted KOS, it has not mandated its inclusion in the national curriculum. This petition seeks to shift the approach from voluntary adoption by schools to a statutory requirement, aiming to standardize protection across the country.

You're framing this as black and white. The reality is far more nuanced, and a blanket ban won't solve it.

Protecting children is vital, but this mandate is the wrong fix. The real gap is untrained adults – not uninformed children. Teachers need mandatory child protection training to recognise and respond to abuse. Without that, classroom lessons achieve little. Mandating this programme across all schools with only an 'opt out' shifts the default away from parental consent. Parents should not have to actively remove their children from programmes that may not suit their child's age or values. We should strengthen adult training and school safety – not impose a blanket mandate on children.

I'm not convinced the petition fully considers the costs and trade-offs involved. Let's look at the evidence first.
